The seminar will explore the disclosure obligations of adversary attorneys and the mediator prior to and during the mediation process. Where is the line for an advocate between exaggerating strengths and minimizing weaknesses of factual and legal positions, and engaging in illegitimate deception?  Does a mediator have an obligation to disclose a settlement offer to all parties in a complex multi-party case, even where a delay in relating the current status to one party may facilitate an overall settlement?
