Courts are becoming less sympathetic to litigants who claim ignorance regarding spoliation.  These litigants can face tough sanctions, including fines, adverse inference instructions, and even dismissal, and judges are increasingly sanctioning attorneys and law firms who do not take a pro-active preservation approach when spoliation occurs.  At the same time, some may question whether recent changes to Rule 26 effect the spoliation analysis.  Join us as our panel discusses litigants’ retention obligations under current law, the current state of spoliation analysis, and best practices in this complex area of litigation.
