WEBCAST | Attorney Client and Work Product Privilege for In-House Counsel: Distinguishing Between the Business Advisor and Legal Counselor Roles

Cliff and Chris will review the attorney-client privilege and work product doctrine. Building on that foundation, they will discuss the complex privilege and work product issues that face in-house counsel. In-house counsel are asked to play a variety of roles in a company. Those roles range from attorney and negotiator, to business advisor and supervisor. Whether communication is privileged can depend on the role in-house counsel is playing, and the way in which in-house counsel communicates in each role. Cliff and Chris will use hypothetical scenarios to show whether communication is protected, and will give guidance on what language in-house counsel should use when making privileged communications.
