Addressing the Current Challenges in International Business Law: Sanctions, FCPA, and GDPR

These are quite uncertain and challenging times in addressing international and cross-border business law issues. Companies doing business internationally are faced with various laws, regulations, and enforcement regimes. Some of the laws and regulations originate in other jurisdictions but may apply to domestic operations. At the same time, the uncertain or changing treatment and enforcement of existing US laws and enforcement regimes can be very challenging for in-house counsel to address appropriately. This CLE overviews and updates on enforcement and compliance trends of the US trade sanctions and export controls, the Foreign Corrupt Practices Act, and the General Data Protection Regulation.

12:00 p.m. - 12:20 p.m. Changing enforcement priorities in U.S. sanctions and export controls can create compliance headaches for in-house counsel.  This presentation will summarize enforcement trends concerning U.S. sanctions and export controls and provide tips for in-house counsel to improve compliance objectives related to international business.  A focus of the presentation will be how to mitigate the risk of third parties unlawfully diverting products from the United States to locations, persons or uses sanctioned under U.S. law.

12:20 p.m. - 12:40 p.m. FCPA enforcement is an increasingly complicated area for corporate counsel to navigate. While the 2018 statistics look fairly typical, recent DOJ/SEC policy announcements and publicized cases together underscore a changing enforcement landscape. This presentation will explore some of those developments and alert in-house counsel to the latest FCPA enforcement priorities.

While large companies have taken steps to address GDPR, many small and medium businesses might have further to go.
