Minnesota is among states with a statutory scheme that allows for early dismissal of "Strategic Lawsuits Against Public Participation,” or SLAPPs. These are lawsuits commenced not to win, but rather to harass and to hinder persons from participating in governmental decisions. The often-overlooked scheme is a powerful tool for defense counsel and a potential trap for plaintiffs’ counsel because it provides for a mandatory award of attorneys’ fees for prevailing defendants but makes no allowance of fees for prevailing plaintiffs.
