Although a lawyer client relationship is an essential element of nearly all claims against attorneys, this presentation will examine some situations in which lawyers may have civil liability to non-clients. Topics will include the third party beneficiary rule outside the estate planning context, the implications of opinion letters, and exposures relating to fraud and aiding and abetting.
